Francis H. Fitzpatrick
Frank retired in 2001 after 50 years of excellence in the practice of law.  He is a founding member of the Fitzpatrick, Zimmerman, and Rose Co., L.P.A.,  Law Firm with Donald W. Zimmerman. Frank, a native of New Philadelphia, Ohio, earned his undergraduate degree from the University of Notre Dame in 1948.  Frank received his Juris Doctorate degree from Western Reserve Law School in 1951.  He was a former member of the United State Marine Corp from 1943 to 1945 and is a member of the Tuscarawas County Bar Association, Ohio State Bar Association and American Bar Association. Frank and his wife, Patricia reside in New Philadelphia.
 
Donald Zimmerman
Don is a founding father of the Fitzpatrick, Zimmerman, & Rose Co., L.P.A. law firm.  Don’s practice currently consists of probate, estate planning and real estate and development law.  Don created this firm with Francis G. Fitzpatrick in 1951.

Don possesses over 50 years of experience in probate and estate planning area as well as real estate and development law.  Don handles a wide range of issues including estate planning, lifetime giving, trust administration, probate, life insurance planning, estate and fiduciary tax return preparation, charitable giving, business succession planning, multi-generational planning, elder law and discount valuation planning.

Don is a native of New Philadelphia, Ohio, received his undergraduate degree from Ohio Wesleyan University in 1949.  Don earned his Juris Doctorate degree from Western Reserve University Law School in 1951.  In addition to being admitted to the Ohio Bar in September, 1951, Don was admitted to the District Court for the Northern District of Ohio in 1976 and admitted to the U.S. Supreme Court in 1986.

Don is very active member in the community Community Service including being past president of Tuscarawas County Bar Association; member of New Philadelphia Rotary Club from 1952 to the present; member of the First United Methodist Church of New Philadelphia; past President of Tuscarawas County Easter Seal Society; Executive Secretary and Board Member of the Greenwalt Trust Fund for Crippled Children; Secretary of the Rotary Hall Memorial Fund for Crippled Children; past member of the Ohio Commission on Aging; Former Chairman of the Board of Trustees of Kent State University,; Member of American Legion; past Solicitor of the Villages of Mineral City, Bolivar, Gnadenhutten, and the City of New Philadelphia; past member and secretary of Tuscarawas County YMCA Board of Trustees; Member of New Philadelphia Elks Club; past member of the Ohio Commission on Local Government Services; past Trustee and Chairman at Union Hospital; member of the National Academy of Elder Law Attorneys; member of Ohio State Bar Association and American Bar Association; present Special Counsel for the Tuscarawas County Metropolitan Sewer District and Atwood Regional Water and Sewer District.

As a result of Don’s substantial activity in the Community, Don has been the recipient of the Tuscarawas County Chamber of Commerce Hall of Fame Award, recipient of the VFW Outstanding Citizens of the Year Award, recipient of Jaycees’ Distinguished Service Award and recipient of Tuscarawas County Historical Society Zeisberger-Heckwelder Humanity-Peace-God-Love Award.

Don resides in New Philadelphia.

 
Frank J. Rose, Jr
Frank practices in estate planning, corporate and business law, including the representation of small and large business, probate, estate, real estate, creditor rights and collection areas.  He joined the firm in 1976 and currently serves as President.

 Frank, a native of Batavia, New York, received his undergraduate degree, magna cum laude, from John Carroll University in 1971, at which time he also received his commission as an officer in the United States Army Reserve.  He earned his Juris Doctorate from Case Western Reserve University in 1974.  He is a member of the Tuscarawas County Bar Association, the Ohio State Bar Association and the American Bar Association.  Frank also taught Real Estate Law from 1979 to 1985 at Kent State University, Tuscarawas Campus, where he attained the rank of Assistant Professor.

 Frank has spoken at numerous Realtor continuing education seminars.  He has also spoken at a variety of estate planning seminars on topics ranging from simple wills and trusts to complex federal estate and gift tax planning.

Frank is very active in serving his community.  Community service has included being a current member and past president of the New Philadelphia Lions Club and was named as a Melvin Jones Fellow in 1994, which is the highest honor conferred by the Lions Club International Foundation; a member of St. Joseph’s Catholic Church in Dover, Ohio; a past member of the Board of Directors and Executive Committee of the Tuscarawas County Chamber of Commerce; a past member of the Board of Directors of Hospice of Tuscarawas County and chairman of the Hospice of Tuscarawas County Endowment Fund Committee; member and past chairman of the Board of Trustees of Kent State University, Tuscarawas Campus, and recipient of the 1994-95 Kent State University Community Service Award; past member and past president of the Tuscarawas Central Catholic High School Board of Trustees and member of the Tuscarawas Central Catholic High School Foundation; past member of the Board of Directors of the Tuscarawas County Easter Seals; and past member of the United Way of Tuscarawas County Allocation Committee; past member of the New Philadelphia Jaycees and past chairman of numerous Eagle Scout Review Committees for local district of Boy Scouts of America.

Frank resides in New Philadelphia, Ohio, with his wife, Sue. They have three children, Frank III, Lisa and Michelle.

 
D. Brad Zimmerman
Brad practices in business and corporate law, probate and estate planning and real estate and development law.  He joined the firm in 1978 and currently serves as Vice President/Secretary.

Brad possesses extensive experience in real estate development, commercial and residential financing, and title law.  He also has extensive experience counseling large and small commercial businesses, medical and professional practices, as well as businesses dealing with day to day employee, vendor and contractual problems.  He regularly handles probate and adoption matters, as well as preparing and revising estate and trust plans.  Brad serves as legal counsel to the Atwood Regional Water and Sewer District and the Village of Midvale, Ohio.

Brad frequently makes speaking presentations on various estate and business planning matters.

Brad is a New Philadelphia, Ohio native who graduated from Ohio Wesleyan University in 1975 with a Bachelor of Art Degree in Politics and Government and from Case Western Reserve University with a Juris Doctor Degree in 1978.  He is a member of the Tuscarawas County Bar Association, Ohio State Bar Association, and American Bar Association.

Brad is active in many community activities including:  current Board Member, Legal Counsel and past President of the Tuscarawas Society for Children and Adult – Rainbow Connection; Eagle Boy Scout and Merit Badge Counselor for 25 years; past Secretary and current Member of the New Philadelphia Rotary Club; R.T.Y. Board Member/Legal Counsel operating Tuscora Park rides and concessions; Board of Director Member of New Philadelphia Quaker Club; Founding Board Member of Park Place Youth Center; Member of New Philadelphia Elks, and First United Methodist Church.

Brad, and his wife, Zoe reside in Dover. They have two sons Andy and Mickey.

J. Greg Miller
Greg practices in real estate law and estate planning.  In addition, he oversees the firm’s real estate title operations conducted by Tuscarawas County Title Company.  He joined the firm in 1991.  Prior to this, Greg was employed in the mortgage and banking industry for 15 years.  Greg’s experience includes assisting individuals in the sale of their personal residence when a realtor is not involved in the transaction.  He will assist individuals in the formation of real estate sales or purchase agreements, the appropriate disclosures as required under both State and Federal law, and seeing the transaction through to closing.  In addition, he has also worked with commercial transactions, once again, both on behalf of buyers and sellers.

Greg graduated from Miami University in 1975 with a Bachelor of Arts Degree in Business and Marketing, and from the University of Akron School of Law with a Juris Doctor Degree in 1989.  Greg graduated from the University of Akron while working full time in the banking and mortgage industry.  He is a member of the Tuscarawas County Bar Association, Ohio State Bar Association and the American Bar Association.

Greg is very active in serving his community.  Community service has included being a member of the New Philadelphia Youth Center Board; the New Philadelphia Little League Board of Directors; treasurer of the New Philadelphia Little League Association; past president and current member of the New Philadelphia Park and Recreation Board for Tuscora Park; and a member of the Board of Trustees of the Dover First Moravian Church.  In addition, he is a former president and member of the New Philadelphia Kiwanis Club.  Greg has also been an active speaker for the Ohio Association of Realtors in teaching real estate law classes through both Buckeye Career Center and Kent State University-Tusc Campus.

Greg resides in New Philadelphia, Ohio, with his wife, Janie.  The Millers have three sons, Joshua, Jordan, and Joel.

Steven A. Anderson
Steven focuses his practice on litigation, family law, contract law, real estate law, collection law,  municipal law, liquor law and criminal law.  Steve joined the firm in 1996.  Steve’s experience includes litigating disputes over the interpretation and enforcement of contracts, general business litigation, collection of debts for clients, representing clients in all aspects of family law representation including divorce, dissolution, child custody and child support proceedings and pre-nuptial agreements.  Steve also serves as the Solicitor for the Villages of Bolivar and Mineral City as well as serving as Prosecutor for the Villages of Bolivar, Mineral City, Midvale and Strasburg.

Steve, a native of New Philadelphia, Ohio, received his undergraduate degree, with honors,  from  Ohio State University in 1992.  Steve earned his Juris Doctorate magnum cum laude, from Capital University in 1996.  While in law school Steve was class president, recipient of the Noah J. Kern academic scholarship, received the American Juris Prudence award in Constitutional Law, the C.A.L.I. award in Criminal Procedure, was a member of Law Review, the Order of the Curia, and served as an intern for Justice Andrew Douglas with the Ohio Supreme Court. 

Steve is very active in the community.  Community Service has included being on the Board of Directors of the Tuscarawas County Big Brothers/Big Sisters Organization; a member of the New Philadelphia Kiwanis; a Real Estate Professor at Kent State University; Chairperson and coordinator of the local Punt, Throw and Kick Competition; chairperson and coordinator for the annual High School Mock Trial Competition.  Steve is a member of the Ohio State Bar Association and Tuscarawas County Bar Association.  Steve previously served as Treasurer of the Tuscarawas County Bar Association and currently holds the position of Secretary.   Steve is a member of Sacred Heart Church in New Philadelphia, Ohio and the New Philadelphia Elks.

Steve, his wife, Toni, and their children, Sydney and Riley reside in New Philadelphia.
 
Paul Hervey

Paul concentrates on civil litigation, family law, divorce, dissolutions, custody matters, and criminal law for the firm.  Paul has tried several hundred cases to verdict, including over 70 jury trials in the past decade, on matters ranging from complex divorce and custody cases to car accidents to business disputes to criminal cases involving the risk of life in prison.

A native of Canton, Paul graduated from Franklin and Marshall College in Lancaster, Pennsylvania in 1991 with a bachelor’s degree in both economics and in government.  While in school, Paul founded and operated a student newspaper and also created and sold computer software to colleges nationwide.  After college, Paul attended Case Western Reserve University’s School of Law in Cleveland, where he clerked with local law firms and gained experience in insurance and labor law before graduating in 1994.  Paul is licensed to practice law in Ohio and the United States District Court for the Northern District of Ohio.

Paul returned to Canton shortly thereafter and worked for the Stark County Public Defender for the next five years.  During that time, Paul was promoted several times, ultimately to senior staff attorney.  Paul also spent time in charge of the office’s juvenile division.  Paul left government work in 2000 to enter private practice.  Having had several cases against Fitzpatrick, Zimmerman & Rose over the years, Paul was asked to join the firm as one of its main litigators (courtroom practitioners) in 2006.

Paul is active in many organizations in the community.  He is the treasurer and a board member of Temple Israel, past treasurer of Temple Israel’s Brotherhood, and chairs several committees within the institution.  Paul is also the past secretary and current board member of the Canton Jewish Community Federation; a member of the Stark County Bar Association; a member of the SCBA’s Criminal Law and Family Law committees; a member of the Tuscarawas County Bar Association; publisher of the TCBA newsletter; and a member of the Ohio State Bar Association.  Prior to starting his family, Paul also took great joy in coaching youth and high school football for many years.

Paul resides in Perry Township, where he is active in school district issues, with his wife Jan and their children, Abigail, Jacob, Madeline, and Cameron.

 
Michael Warkall
Mike is a native of Sugarcreek and a graduate of Kent State University and the University of Toledo’s School of Law.  His practice focuses on real estate, corporate, estate planning and probate law.  FZR looks forward to using Mike’s experience in areas of business formation and representation, real estate agreements and transfers, and estate planning, wills and trusts to serve existing and new clients.  Mike will manage the firm’s office in Sugarcreek.

Mike is involved in several community organizations. He is a member of the Dover Alliance Church, where he serves as a Sunday School teacher and as an instructor in the youth ministry. In addition, he is an Allied Attorney with the Alliance Defense Fund. Currently, Mike is also a board member of the American Red cross and Sugarcreek Rotary Club. He coaches youth baseball, basketball, and football. Mike resides in Sugarcreek with his wife Kris and their three children, Joseph, Luke and Emma.
